Gatto Agency, LLC – SMS/MMS Terms & Conditions

These SMS/MMS Terms & Conditions (“SMS Terms”) govern your participation in the text messaging program provided by Gatto Agency, LLC (“Gatto Agency, LLC,” “we,” “us,” or “our”).
By voluntarily providing your mobile telephone number and opting in to receive text messages from Gatto Agency, LLC, you agree to these SMS Terms and acknowledge that you have read and understood them.
1. Program Description
When you opt in to receive text messages from Gatto Agency, LLC, you may receive SMS or MMS text messages at the mobile telephone number you provide.

By affirmatively opting in to the Gatto Agency, LLC SMS/MMS program, you authorize Gatto Agency, LLC to send text messages to the mobile telephone number you provided for the purposes described in these SMS Terms. Your consent applies to Gatto Agency, LLC and does not constitute consent to receive marketing or promotional text messages from unrelated third parties. You may withdraw your consent at any time as described in the Opt-Out section below. Consent is not required as a condition of purchasing goods or services from Gatto Agency, LLC.
3. Message Frequency
Message frequency will vary depending on your interactions and communications with Gatto Agency, LLC. The number of messages you receive may depend on the nature of your insurance inquiry, quote, policy, service request, or other communications with us.
4. Opt-Out of Text Messages
You may opt out of receiving text messages at any time by sending STOP in response to a text message from Gatto Agency, LLC.
After you send STOP, Gatto Agency, LLC will send a confirmation message confirming that you have been unsubscribed, where technically feasible and permitted by applicable law.
After your opt-out request has been processed, you will no longer receive SMS/MMS messages from Gatto Agency, LLC for which your consent is required, except for a limited confirmation or other communication permitted or required by applicable law. You may also revoke your consent through any other reasonable method that clearly communicates your desire to stop receiving text messages from Gatto Agency, LLC. If you later decide to receive text messages again, you may re-enroll through the available Gatto Agency, LLC opt-in process or, where supported, text START in response to a Gatto Agency, LLC text message.

6. Message and Data Rates
Message and data rates may apply to SMS/MMS messages sent to you by Gatto Agency, LLC and to messages you send to us.
Your wireless carrier's standard messaging and data rates may apply. Gatto Agency, LLC does not control charges imposed by your wireless carrier.
If you have questions about your mobile telephone plan, messaging plan, or data plan, please contact your wireless service provider.
7. Privacy and Text Messaging Information
Gatto Agency, LLC respects your privacy.
Text messaging opt-in data, including your mobile telephone number, SMS/MMS consent, opt-in status, and information related to your consent to receive text messages, will not be sold, rented, or shared with third parties for their own marketing or promotional purposes.
Gatto Agency, LLC will use text messaging opt-in information only as reasonably necessary to:
Service providers that assist Gatto Agency, LLC with text messaging may process information on our behalf as necessary to provide the messaging service. Such service providers are not authorized to use your text messaging opt-in data for their own independent marketing or promotional purposes.

8. No Sale or Transfer of SMS Opt-In Data for Marketing
Gatto Agency, LLC does not sell or rent SMS/MMS opt-in data. Gatto Agency, LLC will not share, transfer, sell, rent, or otherwise disclose your SMS/MMS opt-in data to third parties for their own marketing, advertising, or promotional purposes.
This restriction includes your mobile telephone number and information indicating that you have consented to receiving text messages. This provision does not prohibit disclosures to service providers that process information on behalf of Gatto Agency, LLC solely to provide, maintain, or administer the SMS/MMS service, or disclosures that are required or permitted by applicable law.
9. Carriers and Message Delivery
Wireless carriers are not liable for delayed or undelivered messages.
Message delivery may be affected by factors outside the control of Gatto Agency, LLC, including wireless network availability, geographic coverage, device compatibility, carrier limitations, technical failures, or other circumstances. Gatto Agency, LLC does not guarantee that every text message will be delivered immediately or successfully.
10. Supported Devices and Mobile Numbers
You are responsible for providing a valid mobile telephone number and maintaining a mobile device and wireless service capable of receiving SMS/MMS messages. If you change, deactivate, or transfer your mobile telephone number, you should notify Gatto Agency, LLC so that we can update our records and messaging preferences. You agree not to provide Gatto Agency, LLC with a mobile telephone number belonging to another person without that person's authorization.
11. Your Responsibility for Mobile Charges
You are responsible for any charges imposed by your wireless carrier associated with receiving or sending SMS/MMS messages. Gatto Agency, LLC is not responsible for carrier charges, including messaging, data, roaming, or other wireless service charges.
12. Consent and Revocation
Your participation in the SMS/MMS program is voluntary.
You may revoke your consent at any time by replying STOP or by using another reasonable method that clearly communicates your request to stop receiving text messages.
Gatto Agency, LLC will process valid opt-out requests in accordance with applicable federal and state law. If you send an opt-out request, Gatto Agency, LLC will not require you to take unreasonable additional steps to revoke consent.
13. Prohibited Uses
You agree not to use the Gatto Agency, LLC SMS/MMS program for unlawful purposes or to interfere with the operation of the messaging service.
Gatto Agency, LLC reserves the right to suspend or discontinue messaging to a mobile number when reasonably necessary to comply with applicable law, protect the messaging service, prevent fraud or abuse, or address technical or security issues.
14. Changes to These SMS/MMS Terms
Gatto Agency, LLC may update these SMS/MMS Terms & Conditions from time to time to reflect changes in our messaging program, business practices, technology, or applicable federal or state laws and regulations. When material changes are made, we may update the effective date and, where appropriate, provide notice through our Website or other reasonable means.
Your continued participation in the SMS/MMS program following any permitted changes constitutes acceptance of the updated terms to the extent permitted by law.
